Special Council Meeting
January 9, 2007
The Village of Evendale held a Special Council Meeting on January 9, 2007 to hear the police grievance of Officer Tim Holloway and Officer Jeff McDaniel over the calculation of seniority for the purpose of the Police Sergeant Eligibility List, which grievances were processed in conformance with the provisions of Chapter 258 of the Codified Ordinances of the Village of Evendale.
The Special Meeting was called to order by President of Council, Stiney Vonderhaar. Upon roll call, the following council members were present: Mr. Douglas Lohmeier, Mr. Bill Puthoff, Jr., Mr. Stiney Vonderhaar, Mr. Christian Schaefer and Mrs. Carolyn Smiley-Robertson. Mayor Apking was absent and excused and Mr. Jeff Albrinck was absent and excused because he previously heard the grievances as Vice-Mayor and issued a decision. Also present were: Mr. Stephen Imm, Attorney for Officer Tim Holloway; Mr. William Gustavson, Attorney for Officer Jeff McDaniel; Police Chief, Gary Foust; Assistant to the Mayor, Jack Cameron; Village Solicitor, Tim Burke; and Village Clerk, Michelle Ficke.
Mr. Vonderhaar noted that the revised agenda dated 1-9-07 did not include the Procter and Gamble presentation at P & G’s request.
Police Chief Gary Foust, Officer Jeff McDaniel and Officer Tim Holloway were all sworn in by Tim Burke, Village Solicitor for testimonial purposes.
Officer Tim Holloway presented his grievance before council. Officer Holloway offered testimony and exhibits and was given the opportunity to ask further questions of the Chief and respond to questions from Council. Police Chief Foust presented testimony and exhibits and answered questions from Council.
There was rebuttal from Officer Holloway.
Mr. William Gustavson, Attorney for Officer Jeff McDaniel, presented his position concerning the grievance over the ranking of the sergeant exams on Officer McDaniel’s behalf.
All parties agreed that the testimony and exhibits used in one hearing could be considered by Council in deliberating the other grievance.
Mr. Gustavson gave a final statement.
The meeting was tape recorded to the point that Council went into executive session. The tape, as well as the exhibits introduced, are preserved in the records of the Clerk of Council.
A motion to adjourn into Executive Session to deliberate the police grievance issues was made by Mr. Lohmeier, seconded by Mr. Puthoff and unanimously approved on roll call.
Council reconvened and there be no further business to come before council, a motion to adjourn was made by Mrs. Smiley-Robertson, seconded by Mr. Lohmeier and unanimously approved. Council adjourned at 9:52 pm.
